We reserve the right to change these terms and conditions at any time. Any such changes will take effect when posted on the website and it is your responsibility to read the terms and conditions on each occasion you use this website and your continued use of the website shall signify your acceptance to be bound by the latest terms and conditions.

If you are not a consumer, you confirm that you have authority to bind any business on whose behalf you use this website.

Our contract

When you place an order to purchase a product from Beadles, we will send you an e-mail confirming receipt of your order and containing the details of your order. Your order represents an offer to us to purchase a product which is accepted by us when we send e-mail confirmation to you that we've dispatched that product to you (the "Dispatch Confirmation E-mail"). That acceptance will be complete at the time we send the Dispatch Confirmation E-mail to you. Any products on the same order which we have not confirmed in a Dispatch Confirmation E-mail to have been dispatched do not form part of that contract.

Intellectual Property
You acknowledge and agree that all copyright, trademarks and all other intellectual property rights in all materials and/or content made available as part of your use of this website shall remain at all times vested in us or our licensors. You are permitted to use this material only as expressly authorised by us or our licensors.
 
You acknowledge and agree that the material and content contained within this website is made available for your personal non-commercial use only and that you may only download such material and content for the purpose of using this website. Beadles has taken every care in the preparation of the content of this website, in particular to ensure that prices quoted are correct at time of publishing and all products have been fairly described. However, orders will only be accepted if there are no material errors in the description of the goods or their prices as advertised on this website. All prices are displayed inclusive of VAT. Packaging may vary from that shown. Some product imagery is for illustrative purposes only, so may vary from the actual product.  The weights, dimensions and capacities given are approximate only. We have made every effort to display as accurately as possible the colours of our products that appear on the website. However, as the actual colours you see will depend on your monitor, we cannot guarantee that your monitor's display of any colour will accurately reflect the colour of the product on delivery. To the extent permitted by applicable law, Beadles disclaims all warranties, express or implied, as to the accuracy of the information contained in any of the materials on this website. Beadles shall not be liable to any person for any loss or damage which may arise from the use of any of the information contained in any of the materials on this website.

The ordering process
The ordering process works as follows: At checkout you will submit your contact & delivery details (or login to your account in which your previously supplied contact & delivery details will be stored).  You will then be asked to confirm your order and passed to our payment processor provider to submit your payment details. Once your payment details have been submitted you have then purchased the goods with us via the internet, and therefore have entered into a legally binding contract.

Pricing and availability
We list availability information for products sold by us on the website, including on each product information page. Beyond what we say on that page or otherwise on the website, we cannot be more specific about availability. Please note that dispatch estimates are just that. They are not guaranteed dispatch times and should not be relied upon as such. As we process your order, we will inform you by e-mail if any products you order turn out to be unavailable.

Despite our efforts, a small number of the hundreds of products on our website may be mispriced. Rest assured, however, that we verify prices as part of our dispatch procedures. If a product's correct price is lower than our stated price, we charge the lower amount and send you the product. If a product's correct price is higher than our stated price, we will, at our discretion, either contact you for instructions before dispatch or cancel your order and notify you of such cancellation.

Ordering errors
You are able to correct errors on your order up to the point at which you click on ‘Confirm and Pay’ on the final page of our ordering process.

Payment
We take payment from your card at the time we receive your order, once we have checked your card details. Goods are subject to availability. In the event that we are unable to supply the goods, we will inform you of this as soon as possible. A full refund will be given where you have already paid for the goods.

Title to any products you order on this website shall pass to you on delivery of the products provided that we have processed and received payment in full for the products.
All prices include VAT (where applicable) at the applicable current rates but exclude delivery charges, unless expressly stated otherwise.

Payment Security
We take security very seriously and make shopping online as safe as possible. Your browser will go into secure mode as soon as you access the 'checkout' or 'login' pages, i.e. before you enter any personal or payment details.

You can check that you are shopping in a secure environment by looking for either a locked padlock or a key icon in the grey bar at the bottom of your screen. Being in 'secure mode' means that all of your details are encrypted to help keep them secure. Encryption creates billions of code combinations to protect each transaction made on our site, so your card details cannot be viewed by anyone else using the Internet. We only accept orders that are placed using Secure Socket Layer (SSL). This technology prevents you from inadvertently revealing personal information using an insecure connection. During payment, we also ask for your card billing address as an additional security check. No credit or debit card details are stored once your order has been processed. This is why you can save your favourite delivery address but need to enter your card details each time you order. We recommend that you always close down your Internet browser when you have finished shopping online, especially if you use a shared PC. Delivery
Delivery charges on this website are only for delivery of products to customers in mainland UK and Northern Ireland addresses. Deliveries to the Channel Islands, Isle of Man, Orkney, Shetland and Scottish Islands, BFPO addresses, the Republic of Ireland or any other international deliveries may be subject to additional delivery charges and customs duty (see Customs policy below). All goods must be signed for by an adult aged 18 years or over on delivery.
 
Delivery charges and estimated timescales are specified when you place an order. We make every effort to deliver goods within the estimated timescales; however delays are occasionally inevitable due to unforeseen factors. Beadles shall be under no liability for any delay or failure to deliver the products within estimated timescales.

Risk of loss and damage of products passes to you on the date when the products are delivered or on the date of first attempted delivery by us.

We want you to be totally satisfied with every purchase you make from Beadles. It is our aim to offer you value and quality. Goods supplied by Beadles have manufacturers’ warranties which vary in duration and extent. We will provide details of warranties relating to individual products on request. In the unlikely event that you receive incorrect, faulty or damaged goods.
Manufacturer’s guarantees promoted on the website are in addition to our obligations with respect to your statutory rights, which of course remain unaffected.

Distance Selling Regulations
Under the Distance Selling Regulations, you have a cooling off period of seven working days from the day after delivery of goods. This is an unconditional right to cancel the contract/order for these items. You must inform us by telephoning 0844 248 8473 quoting your order number and stating your intention to cancel your order.

You will then be required to return such goods, in an unused and re-saleable condition at your own cost (Unless in the unlikely event that you receive incorrect, faulty or damaged goods) to:

Alternatively, upon your request we can arrange for the collection of the goods, in an unused and re-saleable condition, from the address specified and shall deduct the cost of this from the cost of your refund.

The customer is responsible for the condition and safekeeping of all goods until collected by us, or, if the customer returns the item to us by their own chosen means, until it reaches us.
A refund will be issued within 30 days of cancellation. This does not apply to items personalised or made to your specification; or vehicles registered in your name; or items of safety equipment such as helmets; or keys special ordered for your vehicle.

When replacing faulty goods, should your substitute goods be unsatisfactory, the cost of returning these will be refunded.

Other returns

If you need to return a product purchased from Beadles Volkswagen then you have 30 days to do so.  The returned goods must be in a resalable state and any goods or accessories that accompany the returned product must also come back to us.

The goods should also be returned with their original accessories.

If the return is due to missing or faulty parts then we will offer a full refund or replacement provided we are aware of this within 30 days.

If you feel the product has been mis-described on our website you may also be entitled to return the goods.

Any refund, which is due to a fault or other defect, will include a refund of the applicable delivery charge.

Faulty or damaged goods - for faulty or damaged goods, in addition to full refunds we can also offer price reductions to the appropriate amount taking the defect into account, repairs and partial refunds.

Customs
When ordering goods from Beadles for delivery overseas you may be subject to import duties and taxes, which are levied once the package reaches the specified destination. Any additional charges for customs clearance must be borne by you; we have no control over these charges and cannot predict what they may be. Customs policies vary widely from country to country, so you should contact your local customs office for further information. Additionally, please note that when ordering from Beadles, you are considered the importer of record and must comply with all laws and regulations of the country in which you are receiving the goods.

Children
Beadles does not sell products for purchase by children. We sell children's products for purchase by adults. If you are under 18, you may use Beadles only with the involvement of a parent or guardian.
Health & Safety Guidelines.

Certain of our products have properties that make them potentially unsafe if misused. You must, upon receipt of any product, read carefully any safety warnings and follow clearly any guidelines on how to use the product. If you are in any doubt about the use of the product, the meaning of any warnings, or whether your intended use of the product is safe, we urge you to contact the manufacturer for clarification prior to use. Beadles will not be held responsible for any negligent use or misuse of products purchased. Nothing in these guidelines should be thought to supersede, or to alter, or to take precedence over manufacturers' instructions. If no instructions are issued and you have a query about how to use the product you are purchasing, we request that you consult the manufacturer.
Some examples of product categories where safety precautions may be appropriate are listed below, for information purposes only.

Hazardous Substances
Manufactured goods falling into these categories will have appropriate labelling, warning information and advice on treatment should accidents occur. Hazardous substances are graded "irritant", "corrosive", "harmful", "toxic" or "poison".
Fume, Mist or Vapour

Certain products may produce fumes, mist or vapour. Before using any product that may produce fumes, mist or vapour a suitable risk assessment must be carried out and necessary precautions taken. Typical precautions will include (but are not limited to) ensuring appropriate ventilation in the work area and the wearing of suitable protective clothing, such as dust-filtering masks or charcoal-based vapour filters.
Tools
Tools can be dangerous if incorrectly used or abused. You must ensure that, when using tools, you take practical precautions to avoid accidents, including the following:

• keep tools securely held and ensure that when working with tools the operator has a good firm foothold, is well balanced and the floor is clean
• always use the right tool for the job. Only use tools for the purpose for which they were designed. Always use the right size tool
• when using a cutting tool, such as a saw, take particular care to ensure that the workpiece is held in a vice or clamp
• keep your free hand well away from the cutting edge of the tool
• always keep cutting tools guarded when not in use, or when being transported
• always be careful with any striking tool to use the appropriate tool for the job. For example, only using a club hammer to drive cold chisels and only using a mallet to drive wood chisels
• protect your body from the tool and, where relevant, from any flying shards or chips produced by using the tool
• use protective eyegear
Electrical Products
A standard electric motor is designed for one voltage only. Always check that the power supply corresponds to the voltage on the rating plate. Do not attempt to operate a 115-volt motor on a 240-volt supply or vice versa.
If an extension cable is required, use an approved extension cable suitable for the power input of the machine. When using a cable reel, always unwind the cable completely.
Ensure any plug is fitted correctly. If in doubt ask a qualified electrician to do it for you. Ensure that the correctly rated fuse is fitted to the plug to suit the power tool or appliance being used.
Never use an electric tool without ensuring that you have read the instructions issued by the manufacturer. If they are missing, ask the manufacturer to supply them to you before you begin using the tool.
When using an electrical tool (particularly outdoors) use a residual current device (circuit breaker or RCD) for enhanced protection.
Aerosol

• store in a cool place out of direct light
• never puncture a container
• never incinerate a container either when full or empty
• follow maker's instructions written on the container
• do not smoke or use near any source of ignition
Cleaning Agents
There are hazards with most cleaning agents. Some cleaning agents may cause severe hand complaints. Others are flammable and many can become toxic under certain circumstances. You must follow carefully the instructions provided with cleaning agents and check if gloves are applicable.
• do not use in confined spaces
• always wear a mask or respirator
• never mix two different cleaning agents or solvents together
• do not smoke or use near any source of ignition
 
Laser Equipment
• do not look directly into a laser beam
• users should take care to ensure the beam does not point directly into people's or animals' eyes when the equipment is on

Electronic communications
When you visit Beadles or send e-mails to us, you are communicating with us electronically. We communicate with you by e-mail or by posting notices on the website. For contractual purposes, you consent to receive communications from us electronically and you agree that all agreements, notices, disclosures and other communications that we provide to you electronically satisfy any legal requirement that such communications be in writing. This condition does not affect your statutory rights.

Losses
Nothing in these terms and conditions excludes or limits liability for death or personal injury caused by negligence, fraudulent misrepresentation, or any other liability which may not otherwise be limited or excluded under applicable law.

Beadles will be responsible for any losses you suffer as a result of us breaching these conditions if the losses were reasonably foreseeable to both you and us when you commenced using the website, or a contract for the sale of goods by us to you was formed. We will not be responsible for any business loss (including loss of profits, revenue, contracts, anticipated savings, data, goodwill or wasted expenditure) or any other indirect or consequential loss that is not reasonably foreseeable to both you and us when you commenced using the website or when a contract for the sale of goods by us to you was formed. Beadles does not limit in any way our liability by law for death or personal injury caused from our negligence or breach of duty or caused by our gross negligence or wilful misconduct.
Notwithstanding the above, Beadles’ aggregate liability (whether in contract, tort or otherwise) for loss or damage shall in any event be limited to a sum equal to the amount paid or payable by you for the product(s) in respect of one incident or series of incidents attributable to the same clause.

We will take all reasonable precautions to keep the details of your order and payment secure, but, unless we are negligent, we cannot be held liable for any losses caused as a result of unauthorised access to information provided by you.

Alteration of Service or Amendments to the Conditions
We reserve the right to make changes to our website, policies, and these Conditions of Use & Sale at any time. You will be subject to the policies and Conditions of Conditions of Use & Sale in force at the time that you use the website or that you order goods from us, unless any change to those policies or these conditions is required to be made by law or government authority (in which case it will apply to orders previously placed by you). If any of these conditions is deemed invalid, void, or for any reason unenforceable, that condition will be deemed severable and will not affect the validity and enforceability of any remaining condition.

Events beyond our reasonable control
We will not be held responsible for any delay or failure to comply with our obligations under these conditions if the delay or failure arises from any cause which is beyond our reasonable control. This condition does not affect your statutory rights.
Waiver

If you breach these conditions and we take no action, we will still be entitled to use our rights and remedies in any other situation where you breach these conditions.

Damage to your computer
Beadles makes every effort to ensure that this website is free from viruses or defects. However, we cannot guarantee that your use of this website or any websites accessible through it won't cause damage to your computer. It is your responsibility to ensure that the right equipment is available to use the website and screen out anything that may damage it. Beadles shall not be liable to any person for any loss or damage which may arise to computer equipment as a result of using this website.

Law, jurisdiction and language
